(B) Seeking out and facilitating the involvement of people potentially affected by the decisions and taking into account community concerns. (C) Informing disadvantaged and tribal community members of opportunities to be appointed to advisory or decisionmaking bodies, thereby empowering those community members to become advisors or decisionmakers.high

(2)(A) Circumstances for which the state board determines, consistent with subparagraph (B), that drought conditions necessitate urgent and immediate action to ensure availability of safe drinking water, to protect public health and safety, or, after consultation with the Department of Fish and Wildlife, to avoid serious and irreparable harm to fish or wildlife.high
#D056Adequate sewer service'Adequate sewer service' means a sanitary sewer service provided by a sewer service provider that is not an inadequate sewer service, as defined in subdivision (j).high
#D057effluent limitation'effluent limitation' means a numeric restriction or a numerically expressed narrative restriction, on the quantity, discharge rate, concentration, or toxicity units of a pollutant or pollutants that may be discharged from an authorized location. An effluent limitation may be final or interim, and may be expressed as a prohibition.high
#D058Toxic hot spotslocations in enclosed bays, estuaries, or any adjacent waters in the 'contiguous zone' or the 'ocean,' as defined in Section 502 of the Clean Water Act (33 U.S.C. Sec. 1362), the pollution or contamination of which affects the interests of the state, and where hazardous substances have accumulated in the water or sediment to levels which (1) may pose a substantial present or potential hazard to aquatic life, wildlife, fisheries, or human health, or (2) may adversely affect the beneficial uses of the bay, estuary, or ocean waters as defined in water quality control plans, or (3) exceeds adopted water quality or sediment quality objectives.high

#D085Designated sewer system'Designated sewer system' means a sewer service provider that serves a disadvantaged community that is either an inadequate sewer service or a sewer system that has a demonstrated failure to maintain technical, managerial, or financial capacity to prevent waste, fraud, and abuse.high
#D086Extension of service'Extension of service' has the same meaning as set forth in Section 56133 of the Government Code.high
#D087Inadequate onsite sewage treatment system'Inadequate onsite sewage treatment system' means an onsite sewage treatment system that has the reasonable potential to cause a violation of water quality objectives, to impair present or future beneficial uses of water, or to cause pollution, nuisance, or contamination of waters of the state.high
#D088Inadequate sewer service'Inadequate sewer service' means a sewer service provider that serves a disadvantaged community, has a demonstrated history of failures to meet regulatory standards for proper wastewater collection, treatment, and disposal, and may exhibit deficiencies, such as infrastructure failure, insufficient capacity, or ineffective treatment of wastewater.high
#D089Onsite sewage treatment system(1) 'Onsite sewage treatment system' means an onsite sewage treatment system, as defined in Section 13290, that is not operated by a local agency, as defined in Section 56054 of the Government Code, or a utility regulated by the Public Utilities Commission. (2) 'Onsite sewage treatment system' includes, but is not limited to, a septic tank, cesspool, leach field, and seepage pit.high
#D090Provision of sewer service'Provision of sewer service' means the provision of sanitary sewer service, including the collection or treatment of sewage, to a disadvantaged community by any of the following processes: (1) Annexation where the receiving sewer system is a special district. (2) Extension of service where the receiving sewer system is a city, county, or special district. (3) Additional sewer service provided within city, county, or special district boundaries.high
#D091Receiving sewer system'Receiving sewer system' means the sewer system that provides service to a disadvantaged community pursuant to this chapter.high
#D092Sewer service provider'Sewer service provider' means any local agency that provides sanitary sewer service, which may include wastewater collection, treatment, disposal, or any combination thereof.high
#D093Special district'Special district' means a special district as defined in Section 56036 of the Government Code.high
#D094Local agency'Local agency' means any of the following entities: (1) A city, county, or city and county. (2) A special district formed pursuant to general law or special act for the local performance of functions regarding onsite sewage treatment systems within limited boundaries.high
#D095Onsite sewage treatment systems'Onsite sewage treatment systems' includes individual disposal systems, community collection and disposal systems, and alternative collection and disposal systems that use subsurface disposal.high
#D096water replacement planA 'water replacement plan' means a plan pursuant to which the discharger will provide replacement water in accordance with a cleanup and abatement order.high
#D097brownfield siteFor purposes of this section, 'brownfield site' means a real estate parcel or improvements located on the parcel, or both that parcel and the improvements, that is abandoned, idled, or underused, due to environmental contamination and that is proposed to be redeveloped.high
#D098nonoperatingAs used in this section, the words 'nonoperating' or 'not in operation' mean the business is not conducting routine operations usually associated with that kind of business.high
#D099waste discharge requirementsThe term 'waste discharge requirements' as referred to in this division is the equivalent of the term 'permits' as used in the Federal Water Pollution Control Act, as amended.high
#D100regulated municipalities and industriesAs used in this section, 'regulated municipalities and industries' means the municipalities and industries required to obtain a storm water permit under Section 402(p) of the Clean Water Act (33 U.S.C. Sec. 1342(p)) and implementing regulations.high
#D101supplemental environmental projectFor the purposes of this section, a 'supplemental environmental project' means an environmentally beneficial project that a person agrees to undertake, with the approval of the regional board, that would not be undertaken in the absence of an enforcement action under this section.high
#D102Health risk assessment'Health risk assessment' means an analysis which evaluates and quantifies the potential human exposure to a pollutant that bioaccumulates or may bioaccumulate in edible fish, shellfish, or wildlife. 'Health risk assessment' includes an analysis of both individual and population wide health risks associated with anticipated levels of human exposure, including potential synergistic effects of toxic pollutants and impacts on sensitive populations.high
#D103Sediment quality objective'Sediment quality objective' means that level of a constituent in sediment which is established with an adequate margin of safety, for the reasonable protection of the beneficial uses of water or the prevention of nuisances.high
#D104Abandoned mine waste'Abandoned mine waste' means the residual of soil, rock, mineral, liquid, vegetation, equipment, machines, tools, or other materials or property on, or discharging from, abandoned mined lands, directly resulting from, or displaced by, surface mining operations.high
#D105Abandoned mined lands'Abandoned mined lands' has the same meaning as 'abandoned surface mined area,' as defined in clause (ii) of subparagraph (A) of paragraph (2) of subdivision (b) of Section 2796 of the Public Resources Code.high
#D106Acid rock drainage'Acid rock drainage' means acid waste discharge that results from the oxidation of metal sulfide in minerals associated with mined lands.high
#D107Mined lands'Mined lands' has the same meaning as set forth in Section 2729 of the Public Resources Code.high
#D108Oversight agency'Oversight agency' means either the state board or a regional board.high
#D109Remediating agency'Remediating agency' or 'agency' means any public agency, or any private individual or entity acting under a cooperative agreement with a public agency, that prepares and submits a remediation plan in accordance with this chapter.high
#D110Remediation plan'Remediation plan' means a plan to improve the quality of the waters of the state that have been directly and adversely impacted by abandoned mine waste.high
#D111notice to complyFor purposes of this chapter, 'notice to comply' means a written method of alleging a minor violation that is in compliance with all of the following requirements: (a) The notice to comply is written in the course of conducting an inspection... (b) A copy... is presented to... an owner, operator, employee, or representative... (c) The notice to comply clearly states the nature of the alleged minor violation, a means by which compliance... may be achieved, and a time limit... (d) The notice to comply shall contain the information specified in subdivision (h) of Section 13399.2...high
#D112Facilities'Facilities' means any of the following: (1) Facilities for the collection, treatment, or export of waste when necessary to prevent water pollution. (2) Facilities to recycle wastewater and to convey recycled water. (3) Facilities or devices to conserve water. (4) Any combination of the facilities described in paragraph (1), (2), or (3).high
#D113Fund'Fund' means the State Water Quality Control Fund.high
#D114Not-for-profit organization'Not-for-profit organization' means an organization operated on a notfor-profit basis, including, but not limited to, an association, cooperative, or private corporation that is a public water system, as defined in Section 116275 of the Health and Safety Code, that meets technical, managerial, and financial capacity criteria specified by the state board for public water systems, or that is subject to regulatory authority pursuant to this division.high
#D115Public agency'Public agency' means any city, county, city and county, district, or other political subdivision of the state.high
#D116Administration fund'Administration fund' means the State Water Pollution Control Revolving Fund Administration Fund.high
#D117Federal Clean Water Act'Federal Clean Water Act' or 'federal act' means the Clean Water Act (33 U.S.C. Sec. 1251 et seq.) and acts amendatory thereof or supplemental thereto.high
#D118Financial assistance(1) 'Financial assistance' means assistance authorized under Section 13480. Financial assistance includes loans, refinancing, installment sales agreements, purchase of debt, and loan guarantees for municipal revolving funds, but excludes grants. (2) Notwithstanding paragraph (1), financial assistance may include grants or other assistance directed by a federal grant deposited in the fund to the extent authorized.high
#D119Grant fund'Grant fund' means the State Water Pollution Control Revolving Fund Small Community Grant Fund.high
#D120Matching funds'Matching funds' means money that equals that percentage of federal contributions required by the federal act to be matched with state funds.high
#D121Municipality'Municipality' has the same meaning and construction as in the federal act and also includes all state, interstate, and intermunicipal agencies.high
#D122Publicly owned'Publicly owned' means owned by a municipality.high
#D123Severely disadvantaged community'Severely disadvantaged community' means a community with a median household income of less than 60 percent of the statewide median household income.high
#D124Qualified nonprofit organization'Qualified nonprofit organization' means an organization with experience in providing financial and technical assistance to disadvantaged communities that is qualified to operate in California and qualified for exempt status under Section 501(c)(3) of the Internal Revenue Code.high
#D125Small water system'Small water system' means a system for the provision of piped water to the public for human consumption that serves at least two, but not more than 14, service connections and is not a public water system as defined in Section 116275 of the Health and Safety Code.high
#D126Agreement'Agreement' means any agreement or contract for financial assistance from the state board to an eligible recipient, including, but not limited to, a loan, grant, installment sale agreement, contract, or other form of agreement made for the purpose of providing financial assistance.high
#D127Recipient'Recipient' means any person or entity that receives any financial assistance from the state board, including, but not limited to, a recipient's contractors or consultants who performs work for a recipient.high
#D128contractor or consultantFor purposes of this section, 'contractor or consultant' means a person whose professional services are engaged to perform work for which public moneys are expended.high
#D129animalFor purposes of this section, 'animal' includes any domesticated bird, bovine animal, horse, mule, burro, sheep, goat, or swine.high
#D130Direct potable reuse'Direct potable reuse' means the planned introduction of recycled water either directly into a public water system, as defined in Section 116275 of the Health and Safety Code, or into a raw water supply immediately upstream of a water treatment plant.high
#D131Raw water augmentation'Raw water augmentation,' which means the planned placement of recycled water into a system of pipelines or aqueducts that deliver raw water to a drinking water treatment plant that provides water to a public water system, as defined in Section 116275 of the Health and Safety Code.high
#D132Treated drinking water augmentation'Treated drinking water augmentation,' means the planned placement of recycled water into the water distribution system of a public water system, as defined in Section 116275 of the Health and Safety Code.high
#D133Indirect potable reuse for groundwater recharge'Indirect potable reuse for groundwater recharge' means the planned use of recycled water for replenishment of a groundwater basin or an aquifer that has been designated as a source of water supply for a public water system, as defined in Section 116275 of the Health and Safety Code.high
#D134Reservoir water augmentation'Reservoir water augmentation' means the planned placement of recycled water into a raw surface water reservoir used as a source of domestic drinking water supply for a public water system, as defined in Section 116275 of the Health and Safety Code, or into a constructed system conveying water to such a reservoir.high
#D135advanced purified demonstration water'advanced purified demonstration water' means product water from an advanced water purification facility that satisfies both of the following requirements: (1) The product water is treated by means of all of the following treatment processes: (A) Microfiltration, ultrafiltration, or other filtration processes to remove particulates before reverse osmosis. (B) Reverse osmosis. (C) Advanced oxidation. (2) The product water meets or exceeds all federal and state drinking water standards and is produced in accordance with the advanced treatment criteria for purified water specified in Section 60320.201 of Title 22 of the California Code of Regulations.high
#D136advanced water purification facility'advanced water purification facility' means a water recycling treatment plant that produces advanced purified demonstration water in accordance with the advanced treatment criteria specified in Section 60320.201 of Title 22 of the California Code of Regulations.high
#D137batch'batch' means an increment of advanced purified treatment water that has completed the treatment process, is separate from incoming water, and is not receiving any additional source water.high
#D138Customer'Customer' means a person or entity that purchases water from a retail water supplier.high
#D139Entity responsible for groundwater replenishment'Entity responsible for groundwater replenishment' means any person or entity authorized by statute or court order to manage a groundwater basin and acquire water for groundwater replenishment.high
#D140Recycled water producer'Recycled water producer' means any local public entity that produces recycled water.high
#D141Recycled water wholesaler'Recycled water wholesaler' means any local public entity that distributes recycled water to retail water suppliers and which has constructed, or is constructing, a recycled water distribution system.high
#D142Retail water supplier'Retail water supplier' means any local entity, including a public agency, city, county, or private water company, that provides retail water service.high
#D143Retailer'Retailer' means the retail water supplier in whose service area is located the property to which a customer requests the delivery of recycled water service.high
#D144Chief plant operator'Chief plant operator' means the person designated by the owner of the wastewater treatment plant as the person responsible for the overall operation of the wastewater treatment plant, including compliance with effluent limitations established in the wastewater treatment plant's waste discharge requirements.high
#D145Operates'Operates' means actions or decisions to control performance or outcome of one or more wastewater treatment processes and includes the supervision of any other person who acts or makes decisions to control the performance or outcome of one or more wastewater treatment processes.high
#D146Wastewater certificate'Wastewater certificate' means a certificate of competency issued by the state board stating that a person has met the requirements to be certified for a specific classification and grade level in the certification program.high
#D147Wastewater treatment process'Wastewater treatment process' means a process that improves the quality of wastewater before it is discharged from a wastewater treatment plant and includes all of the following: (1) Use of preliminary, primary, pond, secondary, or tertiary treatment for liquid-solids separation of wastewater. (2) Use of disinfection to inactivate or destroy pathogens in wastewater. (3) Use of solids treatment for solids stabilization and volume reduction before removal from the wastewater treatment plant site.high

#D150Cathodic protection well'Cathodic protection well,' as used in this chapter, means any artificial excavation in excess of 50 feet constructed by any method for the purpose of installing equipment or facilities for the protection electrically of metallic equipment in contact with the ground, commonly referred to as cathodic protection.high
#D151Monitoring well'Monitoring well' as used in this chapter, means any artificial excavation by any method for the purpose of monitoring fluctuations in groundwater levels, quality of underground waters, or the concentration of contaminants in underground waters.high
#D152Geothermal heat exchange well'Geothermal heat exchange well,' as used in this chapter, means any uncased artificial excavation, by any method, that uses the heat exchange capacity of the earth for heating and cooling, in which excavation the ambient ground temperature is 30 degrees Celsius (86 degrees Fahrenheit) or less, and which excavation uses a closed loop fluid system to prevent the discharge or escape of its fluid into surrounding aquifers or other geologic formations.high
#D153houseboatAs used in this article, 'houseboat' means a watercraft or industrial or commercial structure on or in the waters of the state, floating or nonfloating, which is designed or fitted out as a place of habitation and is not principally used for transportation.
